Within the scope of this Rental between the user and the company HOPINAZORES, Lda, the following conditions are stipulated:

The person who made the reservation is responsible for the booking during the period between the pick-up and the return of the bicycle(s).

  1. The applicant becomes the depositary and caretaker of the bicycle(s) and accessories requested, assuming all civil and criminal responsibility that this condition implies, until their return.
  2. At the time of equipment delivery, each user will be required to present a Citizen Card, proof of residence, or a passport with a valid address or a document (e.g., invoice) stating them as the holder.
  3. The duration of the rental is fixed according to the dates selected in the reservation.
  4. The user shall pay the amount for the vehicle request, according to the table attached to this rental.
  5. The user bears civil or criminal responsibility arising from improper or abusive use of the equipment, including damage caused to third parties resulting from potential traffic accidents or others. Unjustified abandonment of the vehicle will be considered misuse of the equipment, and the user will be subject to a financial penalty to be defined by the company HOPINAZORES Lda.
  6. The vehicle is delivered in perfect working condition, with all documents, tires, tools, and accessories, and the user undertakes to preserve them and drive the vehicle in accordance with the rules of the Highway Code, being expressly prohibited from:
  • Using the vehicle for purposes that are NOT exclusively touristic, and must circulate only on the routes defined for that purpose.
  • Driving the vehicle by persons not authorized in the contract.
  • Using the vehicles for profit-making, commercial purposes, or any other type of use.
  • Ceding, renting, mortgaging, pledging, selling, or any other form of providing as a guarantee.
  • Driving the vehicle in reduced physical conditions, caused by alcohol, drugs, fatigue, or illness.
  • Participating with the vehicle in races, sporting events, etc.
  • Leaving the vehicle unattended when not in use.
  • Disassembling or partially or totally manipulating the vehicle; in case of breakdown, the company HOPINAZORES Lda. must be contacted immediately at the number (+351) 927459343.
  • Circulating off-road, with damage to the vehicle's substructure or mechanical components damaged as a result of poor driving being expressly excluded from insurance coverage.
  • Failing to stop the vehicle as soon as possible when any symbol or alarm indicating an anomaly in the vehicle's operation lights up or sounds, or if one is detected by the user, who must immediately contact HOPINAZORES Lda. at (+351) 927459343 so that the necessary steps can be taken with the insurance company's assistance service. No repair or assistance other than that indicated will be supported without prior authorization from the provider.
  • Driving in an extreme or demanding sporty manner that causes damage to the equipment.
  • Using the vehicle beyond the maximum duration provided for in the rental.
  1. Minors with a height greater than 1.35 m and less than 1.55 m may use electric bicycles, provided that the minor's adult companion accepts the minor's participation and is responsible for all damages caused directly and indirectly to/by the minor as a consequence of using the electric bicycles. Minors must be permanently accompanied by an adult who takes responsibility for the correct use of the electric bicycles. Acceptance of these terms implies acceptance of this condition, allowing the use of the electric bicycle by the minor.
  2. The vehicle may be returned at any time before the final hour indicated in the Contract.
  3. - The rental holder is considered informed of the mandatory use of a helmet. ANY SANCTION OR DAMAGE CAUSED BY THE NON-USE OF A HELMET WITH OUR ELECTRIC BICYCLES SHALL BE THE RESPONSIBILITY OF THE USER.
  4. The company HOPINAZORES Lda. declares to have taken all precautions to avoid mechanical failures in the provided vehicle, but in the event these occur, it assumes no responsibility for damages that may directly or indirectly be caused to the user following said failures or breakdowns.
  5. The user undertakes to pay HOPINAZORES Lda. the charges arising from the loss of tires, tools, accessories, etc.
  • Repair costs for damages caused to the vehicle in the event of an accident, when the following circumstances occur:

- When the vehicle is not used in accordance with the established conditions.

- When the accident report has not been completed within the stipulated period or if it is not in accordance with the facts that occurred.

  • Fines and legal expenses caused by traffic violations or violation of laws by the user.
  1. In case of an accident, the user undertakes to:
  • Obtain complete information from the other party involved and potential witnesses, filling out an accident report to be delivered to HOPINAZORES Lda.
  • Not abandon the vehicle without taking proper precautions to protect it.
  • Immediately communicate any incident to HOPINAZORES Lda. through the contacts provided in the application or the route management computer system.
  1. The temporary assignment contract includes an assistance service.

The user must immediately notify by telephone any breakdown, equipment deficiency, and/or accidents involving users to the company HOPINAZORES Lda., which in turn will contact the insurance company to report the claim. The Insurance Company will activate the means to resolve the incident. If it is not possible to contact HOPINAZORES Lda. and personal injuries or a risk situation have occurred, the user should call the emergency number 112.

  1. - This rental is governed by the general and specific conditions reflected herein. The user declares to have read and understood these conditions and agrees to ACCEPT the terms.
  2. - PROTECTION OF PERSONAL DATA.

In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data (GDPR), and complementary legislation, HOPINAZORES Lda. informs the user that the data provided may be incorporated, if applicable, into the corresponding data processing file, for the exclusive purpose of managing the current relationship and the commitments derived from it; consequently, the user expressly consents to the processing of personal data provided to HOPINAZORES Lda. for the development of this relationship. The user is also informed that, to exercise the rights of access, rectification, cancellation, and opposition, they must contact HOPINAZORES Lda. as the party responsible for the corresponding file or processing.

  1. - LEGAL REGIME OF THE CONTRACT AND COMPETENT JURISDICTION.

This rental is of a private nature and is governed in terms of effects, fulfillment, and termination by private law. For the resolution of all disputes arising from the contract, the jurisdiction of the Court of Horta is stipulated, with express waiver of any other.
